1. Introduction

1.1. Welcome to TariffScout ("TariffScout," "we," "us," "our"), a SaaS platform accessible at tariffscout.net.

1.2. These Terms govern your access to and use of our website, dashboard, email alerts, and any associated services (the "Service").

1.3. By registering at tariffscout.net/register or clicking "I Agree," you accept and agree to be bound by these Terms.

2. Definitions

User: any individual or entity accessing or using the Service.

Free Tier: the no-cost plan that allows tracking of one HTS code + origin country combination.

Paid Tiers: subscription plans priced at $20/mo (Basic) and $50/mo (Pro) that unlock multiple code tracking, priority email alerts, historical analytics, and in-app dashboards.

Content: any text, data, alerts, reports, or materials provided through the Service.

3. Account Registration & Access

3.1. Eligibility: You must be at least 18 years old and have authority to accept these Terms on behalf of any organization.

3.2. Registration: Provide a valid email address and create a password; verify via confirmation link.

3.3. Free Tier Limits: Track exactly one HTS code + origin country.

3.4. Security: You are responsible for safeguarding your login credentials; notify us immediately of any unauthorized use.

3.5. Termination: We reserve the right to suspend or terminate accounts for violations or inactivity.

4. Service Description

4.1. Monitoring & Alerts: We ingest HTS code data from the USITC and Federal Register API to generate tariff-change alerts via email and in-app dashboard.

4.2. Data Sources: Public APIs (USITC, Federal Register); no government affiliation.

4.3. Beta/Waitlist Notice: The Service is in MVP/beta; features and data quality may evolve.

5. Fees & Payment (Paid Tiers)

5.1. Plans & Pricing:

Basic: $20/month (up to 5 codes)

Pro: $50/month (up to 20 codes)

Annual subscriptions receive a 15% discount.

5.2. Billing: Monthly in advance via Stripe; auto-renewing until canceled.

5.3. Failed Payments: Access will be suspended after 5 days of non-payment.

5.4. Refunds: No refunds for partial-month usage.

6. User Obligations & Conduct

6.1. Use the Service only for lawful purposes.

6.2. Do not reverse-engineer, scrape, or circumvent any technical measures.

6.3. Input accurate HTS codes and country data; we are not responsible for user entry errors.

7. Intellectual Property

7.2. You retain ownership of any data you submit; you grant us a license to process it for Service delivery.

8. Privacy & Data

8.1. Our Privacy Policy governs data collection and use.

8.2. We may use aggregated, anonymized data for analytics and improvements.

9. Disclaimers & Limitations

9.1. No Warranties: The Service is provided "AS IS" without warranties of any kind.

9.2. Data Accuracy: We strive for accuracy but cannot guarantee real-time or error-free data.

9.3. Third-Party Dependencies: Service availability depends on external APIs (USITC, Federal Register).

9.4. Limitation of Liability: Our liability is limited to the amount paid in the 12 months preceding any claim.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Service or violation of these Terms.

11. Termination

11.1. Either party may terminate at any time with notice.

11.2. Upon termination, access ceases immediately; data may be retained per our Privacy Policy.

12. Changes to Terms

We may update these Terms; continued use constitutes acceptance of changes.

13. Governing Law & Disputes

13.1. These Terms are governed by Ohio state law.

13.2. Disputes will be resolved through binding arbitration in Cleveland, OH.
